Download is only available if gametes have been acquired by purchaser(s)


Purchaser(s) must either own ovum/sperm or acquire them through donor(s)
a. donor(s) must intend to be a parent prior to download if they want to be considered a parent under the Family Law Act (pre-conception agreement not included)


If purchaser is “birth mother,” they can be the sole parent, include donor (prior to download), or include other purchaser if they are married or in a marriage-like relationship together.
a. Terms & Conditions must use “birth mother” as defined under the Family Law Act, but acknowledges the gendered assumptions and discrimination the word “mother” creates and facilitates
b. It’s suggested that this download be avoided by purchasers who wish to avoid the institution of marriage. Exceptions cannot be made to who is eligible as a legal parent under the Family Law Act…even if potential purchasers are two loving friends.
c. Terms & Conditions recognizes the potential for more than three legal parents but must restrict it to three because of the Family Law Act.
i. legal costs, time, stress, and uncertainty of adoption are not included in this download


If purchaser is not the “birth mother,” they must be connected to them in one of the ways described above
a. exceptions include if “birth mother,” is a surrogate where an agreement is made between surrogate and purchaser(s) who are the intended parent(s) and surrogate surrenders the child
i. the complications associated with this relationship, the written agreement, potential legal costs, risk that surrogate refuses to give written consent and surrender the child after birth, and lack of legal remuneration for surrogate are outside to scope of this download
ii. Terms & Conditions also doesn’t deal with the discrimination around surrogacy and what relationships are usually reliant on a surrogate


Purchaser(s) cannot choose the sex of the child unless they have a proven, serious, hereditary genetic disorder that is linked to a particular sex.
a) If Purchaser(s) wish to choose the sex of the child, facilities in the USA are available at a reduced cost to Canadians
b) Cost of doctor visits/notes to prove genetic disorder are not covered in download

Cost will vary if purchaser(s) want to have preimplantation genetic testing included in download
